Overview:
Mental health clinicians frequently encounter clients whose symptoms, safety concerns, or functional impairments suggest the need for a higher level of care, yet clients may refuse recommendations for hospitalization, intensive outpatient treatment, partial hospitalization programs, residential treatment, or other supportive interventions. These situations can create significant clinical and ethical tension as providers attempt to balance client autonomy with safety, risk management, legal responsibilities, and professional judgment. Clinicians are often left navigating uncertainty while determining when to continue outpatient treatment, when to escalate intervention efforts, and how to ethically respond when a client declines recommendations that may be clinically necessary.

In this presentation, Dr. Zairys Feliz, Ph.D., LCSW, will guide participants through practical approaches for working with clients who resist or refuse higher levels of care while maintaining therapeutic rapport and prioritizing safety. Attendees will explore common reasons clients decline treatment recommendations, including fear, stigma, trauma histories, financial barriers, family concerns, cultural beliefs, ambivalence, and previous negative experiences with treatment systems. Participants will examine strategies for assessing decisional capacity, evaluating risk severity, utilizing motivational and relational interventions, and documenting clinical decision-making. The course will also address ethical dilemmas surrounding autonomy, involuntary treatment considerations, consultation practices, and managing clinician liability concerns. Through case examples and applied discussion, participants will gain practical tools for navigating one of outpatient therapy’s most difficult and legally sensitive challenges.

This training does not provide legal advice, crisis certification, or comprehensive instruction in involuntary commitment procedures, which vary across jurisdictions.
